General
These conditions apply on all sales agreements and services between us and our customers are binding, unless agreed differently in writing.
Quotations
Our quotations are without obligation, the given delivery period will be respected as much as we are able to. When this delivery period exceeded it does not relieve the customer from their obligations in the agreement.
Prices
We have the right to raise agreed prices, if the finished products from our supplier increases the prices after our confirmation, or in case some raw materials we require, which are usually locally obtainable, are not available at the time of executions and need to be imported from elsewhere.
Payment
Payment needs to take place prior to delivery to the amount stated in the invoice without subtraction of any discount.
Transportation
The transportation of goods always happens at risk of our customer. Unless a shipment is under €150 ex VAT, the transportation is carriage.
Delivery
The goods are supposed to be delivered, if these are offered at the address of the customer. In case the customer falls behind on any payment, we have the right to cancel transactions which are in progress, or deliver them later, according to the seller’s insight.
Reservation of ownership
The delivered goods remain our property, until the customer has paid all deliveries we made.
Force majeure
In case we are hindered to execute the agreement due to force majeure, or if this becomes more costly or onerous, we have the right to cancel or suspend the agreement completely or partially, without juridical intervention, to or choosing wherein we cannot be held to any guarantee or compensation. Force majeure is being defined as all events which lay outside of our control.
Commercials
Commercials do not apply, unless they arrive at us in writing within ten days after you received the shipment.
Packaging
Returns of empty packaging are expenses for the buyer.
Disputes
Disputes which occur with our customers for any reason will be adjudged by the competent judge of the arrondissement Amsterdam, unless we prefer to approach a designated judge. The Dutch law applies at all times.
